These Terms of Use (“Terms”) govern access to and use of https://www.sharadkhare.in and related offerings operated by or on behalf of Sharad Khare. By accessing or using the site, SAMAYA AI, or referenced software, you agree to these Terms. If you do not agree, please do not use our services.
1. About our services
Sharad Khare provides strategic consulting, enterprise advisory, decision intelligence content, and software tools including Samaya and SAMAYA AI. Information on this site is for general orientation unless you enter a separate written engagement agreement.
2. Eligibility and account responsibility
You must use the site lawfully and in a manner consistent with these Terms. You are responsible for activity on your devices, including data stored locally in SAMAYA AI and any credentials used to access third-party platforms linked from this site.
3. Consulting and advisory engagements
Discovery conversations, proposals, statements of work, non-disclosure agreements, and signed contracts govern formal consulting and advisory work. Where those documents conflict with these Terms, the engagement-specific agreement prevails for that engagement.
Advisory availability is selective. Submission of an inquiry does not create a client relationship or obligation to accept an engagement.
4. Intellectual property
Unless otherwise stated, all content on this site — including text, graphics, branding, frameworks, and software descriptions — is owned by Sharad Khare or licensors and protected by applicable intellectual property laws.
You may view and download content for personal, non-commercial reference. You may not copy, scrape, mirror, republish, reverse engineer, or create derivative works from site content or software without prior written permission, except where expressly allowed (such as open-source repositories linked from the site).
5. Samaya software and SAMAYA AI
SAMAYA AI is provided as a research-preview web experience. It generates numerology-oriented interpretations, personal timing guidance, number and naming checks, and optional Vedic / Panchang / Kundli-oriented insights for educational and exploratory use. Output may be incomplete or inaccurate. You are responsible for verifying important decisions independently.
Samaya applications (Windows desktop, Android, or other distributions based on the Flutter Samaya app) are provided according to their respective license terms, release notes, and store policies. Chart and Panchang calculations run on-device where bundled. Software is supplied “as is” to the extent permitted by law.
Client profiles and chat data stored in your browser through SAMAYA AI are your responsibility to manage, back up, and protect on shared devices.
6. Acceptable use
You agree not to:
- Use the site or tools for unlawful, harmful, or fraudulent purposes
- Attempt unauthorized access to systems, data, or accounts
- Interfere with site operation, security, or other users’ access
- Automate excessive requests, scrape content at scale, or misrepresent affiliation with Sharad Khare
- Upload or transmit malware or content that infringes third-party rights
- Present AI-generated or site content as guaranteed professional, legal, financial, or medical advice
We may suspend or restrict access if we reasonably believe these Terms have been violated.
7. Third-party links and services
The site links to third parties including LinkedIn, GitHub, and Nakshatra InnoTech. Those services are governed by their own terms and policies. We are not responsible for third-party content, availability, or practices.
8. Disclaimers
Site content, SAMAYA AI output, and general advisory materials are provided for informational and educational purposes. See our Disclaimer for important limitations regarding professional advice and outcomes.
9. Limitation of liability
To the fullest extent permitted by applicable law, Sharad Khare and affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from use of the site or tools.
Where liability cannot be excluded, total liability for claims relating to the site or free tools shall not exceed the amount you paid us for the specific service giving rise to the claim in the twelve months preceding the claim, or one hundred Indian rupees (INR 100) if no fee was paid.
10. Indemnity
You agree to indemnify and hold harmless Sharad Khare from claims arising out of your misuse of the site, violation of these Terms, or infringement of third-party rights, except where caused by our gross negligence or willful misconduct.
11. Privacy
Our collection and use of information is described in the Privacy Policy, which is incorporated into these Terms by reference.
12. Changes
We may modify these Terms at any time. Material changes will be reflected in the “Last updated” date. Continued use after changes constitutes acceptance.
13. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in India shall have exclusive jurisdiction, subject to mandatory consumer protections in your jurisdiction where applicable.
